Impact Nation Privacy Statement

Impact Nation recognizes the importance of privacy, security, and data protection. Moreover, data protection laws give you certain rights over your personal data, no matter when or where it is being processed. This Privacy Statement informs you of our privacy practices and of the choices you can make and rights you can exercise in relation to your personal data, including information that may be collected from your online activity and interactions you have with Impact Nation offline. 

This Privacy Statement applies to all Impact Nation companies as well as Impact Nation owned website and those of our subsidiaries and affiliates (www.impactnation.tech and its subdomains the “Site”).

This Privacy Statement is incorporated within our Terms of Use on the Site (the “Terms”). Please note that this is a master privacy statement and some of its provisions only apply to individuals in certain jurisdictions. For example, the legal basis described below is only relevant to GDPR-protected individuals.

It is important that you understand there is no requirement by law for you to provide Impact Nation with your personal details – the information you share with us is entirely voluntary, and you may avoid providing such information either by not filling in specific forms or by disabling cookies. In addition, it is not possible to avoid processing of certain data when you use the Site. The logging of certain data (but not usually personal data) cannot be prevented for technical reasons.

What Information We Collect; Why We Collect It; and How We Use It

For purposes of this Privacy Statement, “personal data” is information that is defined as “personal data” or “personal information” under applicable law. This includes information that identifies you directly or indirectly, including unique identifiers like IP addresses or cookie IDs. 

Personal data is any information that personally identifies you or from which you could be identified either directly or indirectly. We may collect your personal data through your use of the Site or other services or interactions with our representatives. The categories of personal data we collect from you depends on the nature of your interaction with us or on the Site, but may include the following:

Activity and System Data (Information Automatically Collected Including through Cookies)

When you visit the Site, we automatically collect data about your computer or mobile device, including personal data such as your IP address, device ID, time-zone, the address of the website from which you arrived and other clickstream behavior (such as the pages you view, for how long, or the links you click). We also collect anonymous and aggregated information about how our services are used. In certain cases, we apply a process of de-identification or pseudonymization to your data to make it reasonably unlikely to identify you using that data with available technology.

Purposes is the Data Collected: We use activity and system data to monitor and ensure the orderly and proper operation and development of the Site and for service quality and security, planning and control of server and network capacities, and technical fault and diagnosis. Additionally, we use such data to analyze and derive statistical information with the goal of improving your experience and the content that is presented to you on the Site. 

Legal basis (GDPR only): Consent and Legitimate interest in customer satisfaction, competitiveness, and compliance.

Please note: Some web browsers incorporate “Do Not Track” features. Currently, no industry standard exists for handling “Do Not Track” requests, therefore at this time, the Site may not respond to “Do Not Track” requests or headers from these browsers.

Contact Data 

We may collect personal contact information including your first name, last name, mailing address, telephone number, email address, country, company name, and other similar data and identifiers. 

Purposes is the Data Collected: We use contact data to communicate with you about the Site and our services. Examples of administrative communications may include responses to your inquiries or requests, communications required by law or applicable corporate updates related to mergers, acquisitions, or divestitures. 

We may also use contact data to conduct ordinary business operations, verifying your identity, analytics, planning and strategy, corporate reporting, and quality assurance purposes (which may include monitoring or recording calls to our customer support). Additionally, we may use it for compliance with applicable laws, regulations, court orders, and government and law enforcement requests to operate our services and products properly and to protect ourselves and our users. Information collected may also be used to investigate security incidents and potential breaches of personal information, notify individuals and third parties of the breach, and to prepare to defend lawsuits.

You may use contact data to provide informational newsletters through e-mail if you have provided consent. You may withdraw your consent at any time by writing to privacy@impactnation.tech. You can stop the delivery of all marketing emails by following the "unsubscribe" link in any messages we send you.

Financial and personal information for Investment Purposes

We may collect financial and personal information.

Purposes is the Data Collected: We use this information for investor evaluation processes.

Legal basis (GDPR only): Processing is necessary for the performance of a contract to which the data subject is party or to take steps at the request of the data subject prior to entering into a contract and consent.

Children’s Privacy

The Site is made for the general public. We do not knowingly collect data from children as defined by local law without the previous consent of their parents or legal guardians or as otherwise permitted by applicable law. If you are under 18, do not use or provide any information on the Site. Notwithstanding the foregoing, if you reside in a state, country, or other jurisdiction that requires a higher minimum age for your use of the Site or participation in its activities, you must comply with the applicable law. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information via the Site without his/her consent, then he or she should contact us at the information described below. If we become aware that a child under the age of 18 has provided us with personally identifiable information, we will delete such information from our files.

Sharing your Personal Data

We do not, and will not, sell personal data to third parties. We do permit third parties to collect the personal data described above through the Site and share personal data with third parties for business purposes as described in this Privacy Statement, including but not limited to providing advertising on our services and elsewhere based on users’ online activities over time and across different sites, services, and devices (so-called “interest-based advertising”). The information practices of these third parties are not covered by this Privacy Statement.

We do share your personal date with third parties to help us use your personal data, as described above. For example:

Affiliates

We may share your personal data with our affiliates, where this is necessary to provide you with our products and services and so that we can manage our business, such as to keep updated records of our users. A list of our affiliates is available at here.

Service Providers and Partners

We engage service providers or partners to manage or support certain aspects of our business operations on our behalf. These service providers or partners are located in various global locations and may provide services such as IT services, email service providers, and data hosting. Our service providers and partners are required by contract to safeguard any personal data they receive from us and are prohibited from using the personal data for any purpose other than to perform the services as instructed by us. 

Additionally. we use Google Analytics to help us understand how our customers use the Site. Change of Ownership

If we are looking to sell our company, liquidate assets, or merge with another, we may share your personal data with other interested parties as part of negotiations toward that transaction. In such case, or where we do sell our company, your personal data shall continue to be subject to the provisions of this Privacy Statement, as amended from time to time.

Compliance with Law

We may share your personal data with government agencies or other relevant parties, such as a law office or independent auditor: (i) if we believe that such disclosure is appropriate to protect our rights, property, or safety (including the enforcement of the Terms and this Privacy Statement) or those of a third party; (ii) if required by law or court order; or (iii) as is necessary to comply with any legal and/or regulatory obligations, such as audit requirements.

Data Transfers and Global Processing

The Site may be operated in countries other than your own location, and your personal data may be accessed and/or processed from and/or transferred to countries other than your own location. We may do this where data is accessed/processed for any of the basis identified above. By consenting to the collection and use of your personal data, you agree to your personal data being transferred and stored in this manner and for the specified purposes. The safeguards we deploy for performing such transfers across boundaries: Adequacy. Any transfers to our affiliates may be made based on an adequacy decision made by the European Commission; Model Clauses. With some of our processors, we use standard contractual clauses approved by the European Commission that are binding standards of processing of Personal Data committed to contractually by third parties processing information for us and on our behalf.

Security

The security of your personal data is our highest priority. We work hard to make sure that your personal data will be held securely and that it will not be shared or lost accidentally. We follow generally accepted industry standards to protect the information you submit to us. We maintain industry-standard physical, technical, and administrative safeguards to protect your personal data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of your personal data in our possession. However, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards. The security of your data also depends on the security of the devices you use and the way in which you protect your user IDs and passwords. Technical Measures

The electronic safeguards we employ to protect your personal data include secure servers, firewalls, and antivirus protections.

Access Control

We limit access to your personal data only to authorized personnel who have a need to know, including account managers, customer support staff, and software developers. We review these permissions regularly and revoke access as soon as reasonably possible after termination of any such personnel.

Internal Policies

We maintain and regularly review and update our privacy related and information security policies. 

Database Backup

Our databases are backed up and verified regularly. Backups are encrypted and stored within the production environment to preserve their confidentiality and integrity.

Notwithstanding the foregoing, no method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security. You use the Site and our products and services at your own risk, and you are responsible for taking reasonable measures to secure your account (like using a strong password).

Social Media Features

We may provide social media features that enable you to share information with your social networks and to interact with us on various social media sites, including Facebook, LinkedIn and Twitter. Your use of these features may result in the collection or sharing of information about you, depending on the feature. We encourage you to review the privacy policies and settings on the social media sites you use to make sure you understand the information that is collected, used, and shared by those sites.

Data Retention

We retain your personal data as long as necessary to fulfill each of the purposes we described above. When deciding how long to store personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized access, the purposes for which the personal data was collected, as well as applicable legal requirements. Please note that we may delete information from our systems without notifying you first. Retention by any of our service providers or subcontractors may vary in accordance with each business's retention policy. 

In some circumstances, we may store your personal data even after we're finished using it if required to do so by law (e.g., to fulfill tax or audit requirements) or to keep accurate records of our interactions in case there is a prospect of litigation relating to your personal data. In such cases, we will maintain the same security measures as described above. Data Subject Rights 

The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals protected (for example those protected by the GDPR):

  • You have a right to access personal data held about you. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law;
  • You have the right to request that we rectify any personal data we hold that is inaccurate or misleading;
  • You have the right to request the erasure/deletion of your personal data from our records. Please note that there may be circumstances in which we are required to retain your personal data, for example for the establishment, exercise or defense of legal claims;
  • You have the right to object, to or to request restriction, of the processing;
  • You have the right to data portability. This means that you may have the right to receive your personal data in a structured, commonly used and machine-readable format and that you have the right to transmit that data to another controller;
  • You have the right to object to profiling;
  • You have the right to withdraw your consent at any time. Please note that there may be circumstances in which we are entitled to continue processing your data, in particular, if the processing is required to meet our legal and regulatory obligations. Also, please note that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
  • You also have a right to request certain details of the basis on which your personal data is transferred outside the European Economic Area, but data transfer agreements and/or other details may need to be partially redacted for reasons of commercial confidentiality; and
  • You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution.

Cookies and Similar Technologies

For information about how we use cookies and similar technologies, please see our Cookie Notice available on the Site. Cookies are small files that are saved on your computer or mobile device when you visit or use the Site. Cookies save certain settings via your browser as well as data regarding the exchange of information with the site via your browser. When cookies are activated, a cookie ID is assigned that is used to identify your browser and to use the information collected in the cookie. Cookies capture usage information, such as the date and time of your visit, the name of the site you visited, the IP address of your device and the operating system you use.

Most of the cookies we use are temporary session cookies, which are automatically deleted from your computer or mobile device after your browser session has been ended. We also use permanent cookies. These remain saved on your computer or mobile device after you end your browser session. Depending on the type of permanent cookies used, they can remain on your computer or device for between one month and 10 years and are then automatically deactivated after the programmed period has expired.

Cookies help us to make several functions available on our Site, and, with your consent, we can also capture and analyse the usage behaviour of users who visit the Site. This, in turn, enables us to create a more user-friendly and effective Site and make your visits as enjoyable as possible. 

You can change your cookie settings at any time here. If you decide to reject our cookies or the cookies and tools of one of our partner companies, you may not be able to see certain information on the Site or use some of the functions that are intended to improve your experience.

Analytic Tools

We use Web analysis tools to obtain information about how people use the Site. These tools are usually provided by third parties. Typically, information on the use of an internet site is captured using cookies and sent to a third-party server. Depending on the third-party provider, these servers are sometimes in other countries.

  • Google Analytics. The Site uses a tool called “Google Analytics” to collect information about use of the Site. Google Analytics collects information such as how often users visit the Site, what pages they visit when they do so, and what other websites they used prior to coming to the Site. We use the information we get from Google Analytics to maintain and improve the Site and our products. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Service, available at https://marketingplatform.google.com/about/analytics/terms/us/, and the Google Privacy Policy, available at http://www.google.com/policies/privacy/. You may prevent your data from being used by Google Analytics by downloading and installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout/.
  • Advertising Partners. Through our services, we may allow third party advertising partners to set technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, mobile/website identifiers, page(s) visited, location, time of day). We also may combine and share such information and other information (such as demographic information and past purchase history) with third party advertising partners. These advertising partners will potentially use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioural advertising. We may allow access to other data collected by the services to share information that may be useful, relevant, valuable, or otherwise of interest to you. If you prefer not to share your personal information with third party advertising partners, you may let us know.

We reserve the right to remove or add new analytic tools.

If we modify our Privacy Statement, we will post the revised statement here, with an updated revision date. If we make significant changes to our Privacy Statement that materially alter our privacy practices, we may also notify you by other means, such as sending an email or posting a notice on the Site prior to the changes taking effect.
